Competition regulations
General provisions:
1.1. These Regulations specify the rules, scope and conditions for participation in competitions organized on Facebook and Instagram.
1.2. The organizer of the competition (hereinafter: "Organizer") is the online store www.store.aoomistudio.livewhose owner is Aoomi Studio Limited Liability Company based in Pawłowice, address: ul. Astrów 20, 43-250 Pawłowice, identifying with the number NIP 6381851435, REGON 523891511 hereinafter referred to as "Organizer".
1.3. The competition is conducted in the territory of the Republic of Poland, via the website at: https://www.instagram.com/aoomistudio/ (hereinafter "page").
1.4. Participants can take part in the competition in dates strictly specified in the Instagram competition post.
1.5. The participant in the competition may only be a natural person who has a place of residence in Poland, who has completed thirteen years (hereinafter: "Participant"), with the proviso that a person who is under 18 may take part in the competition with the consent of his statutory representatives.
1.6. Employees, colleagues or representatives of the organizer, as well as members of the immediate family of these people, cannot participate in the competition. The immediate family members are understood as: preliminary, descendants, siblings, spouses, siblings, siblings of the spouses, parents of the spouses and people remaining with the above -mentioned people in the adoption relationship.
1.7. Participation in the competition, as well as rights and obligations related to it, including the right to request a prize, cannot be transferred to other persons and entities.
- Conditions for participation in the competition:
2.1. The condition for participation in the competition, subject to the other provisions provided for in these Regulations, is:
2.1.1. Sending the competition work under strictly defined conditions described in the instagram competition post.
2.1.2. In the case of competitions in which the number of likes or comments of the competition application decides about the victory, applications in which, in a way or violating the good of other Instagram users, are obtained in a disqualification.
2.1.3. Meeting the conditions referred to in para. 2.1. Above, it is a formal application of the participant to the competition (hereinafter: "Application"). The participant may submit many applications during the competition. One participant can win during the entire competition only once.
2.2. The competition application cannot be edited, changed during the competition, only in a unique case after prior agreement with the administrator of the competition.
2.3. Subject to the remaining conditions set out in the Regulations, the competition application must meet the following conditions:
2.3.1. It must be prepared in Polish, this applies to text reports.
2.3.2. It cannot contain profanity, offensive, obscene content or content contrary to the law,
2.3.3. It may not contain advertising content regarding any other entities, except for advertising content regarding the organizer or the products he offers;
2.3.4. He may not violate the rights of third parties, in particular personal rights, copyright and the right to image protection.
2.4. In the event of the organizer that the competition application does not meet any of the conditions specified in these Regulations, the Organizer reserves the right not to take into account the participant who proposed it as part of the application, when the competition is resolved. The participant may submit a complaint in connection with the organizer's decision, on the principles set out in point 7.5. these regulations.
- Prizes:
3.1. Prizes in competitions implemented on Instagram are specified in competition posts.
3.2. Prizes in the competition are not subject to exchange for cash equivalent.
- Decision of the competition:
4.1. The competition will be settled by a commission appointed by the organizer.
4.2. The Commission will grant the awards described in point 3.1. and 3.2. The participant whose competition application will meet the requirements set out in these regulations and who will be considered the best in terms of ingenuity, creativity and originality. In some competitions, the number of likes or comments on the competition application may decide on victory.
4.3. In each case, as part of the competition, the number of prizes and their value is strictly specified in the instagram competition post. Participants who will be awarded the prize will be mentioned in the commentary under the competition post, after the competition.
4.4. A participant who will acquire the entitlement to the prize will be further called the "laureate".
4.5. The results of the competition will be announced by the Commission up to 7 days from the date of the completion of the competition in the commentary under the competition post.
4.6. The organizer will inform the laureate about the award of the award by sending a private message on Instagram. The laureate is obliged to send correct contact details (name, surname, street, city, zip code, telephone number). Along with the information about the award of the award, the Organizer will inform the laureate about the obligation to send additional data specified in point 4.9 of the regulations that are a prerequisite for the prize.
4.7. The prize will be delivered by traditional, electronic or courier at the Organizer's expense, to the winner's address provided in accordance with point 4.6. The prize will be sent within thirty (30) business days from the date of receipt by the Organizer's information referred to in point 4.6.
4.8. The obligation indicated in point 4.7. It covers only the territory of the Republic of Poland. In the event that the place of transfer of the prize was outside the territory of the Republic of Poland, the organizer has the right to abstain with the transfer of the prize until the winner was received from the winner equivalent to the costs of shipping the prize outside the territory of the Republic of Poland.
4.9. Due to the fact that, in accordance with applicable law, in connection with the winner's winner in the competition, there is an obligation to pay income tax on winnings, the laureate will be obliged to provide the data necessary to fulfill the obligations of the Organizer specified in the law specified in the law, in particular providing the PESEL number, NIP number and indicating the tax office competent for the winner (name and exact address). If within 7 days from the date of receipt of the notification of the victory, in the manner referred to in point 4.6. Above, the organizer will not receive to the address indicated by the organizer of the organizer indicated in the participant's data form, the winner loses the right to collect the prize.
4.10. The tax payer referred to in point 4.9. Above is the organizer. The prize will be issued after the organizer collects tax on the laureate. The organizer has the right to deduct the amount of tax due tax due from the amount of the additional benefit referred to in point 3.2. these regulations, to which the laureate agrees.
4.11. In the absence of a prize, as a result of providing incorrect data or changing the laureate's data, about which the Organizer has not been informed, or in the event of the laureate failure to meet the conditions referred to in these Regulations, as well as in the case of a three -time unsuccessful attempt to deliver the prize, the winner loses his right to receive the prize.
4.12. In the event that it turns out that the winner of the competition is a person who does not meet the conditions set out in the regulations, such a person loses the right to receive the prize, and the competition committee re -selects the winner of the competition.
- Using a competition application:
5.1. The organizer acquires from the laureate, without the obligation to pay remuneration, and only in exchange for the award received, without temporary and territorial restrictions author's property rights and depending on competition work created by the winner in the following fields of operation:
- a) in the scope of consolidation and multiplying - the performance of copies of the song in any technically possible form and multiplying with any technique in any number of copies, including in particular digital, printing, reprographic, magnetic recording technique, in particular
- b) placing on the market, lending or renting copies of the song,
- c) The use of all or individual elements of the competition work for the purposes of creating any advertising materials and using them as part of advertising materials, by recording and multiplying the techniques described in lit. and above, and placing on the market, renting, lending, as well as public sharing in such a way that everyone can have access to them in place and during their chosen time,
- d) introduction to the computer,
- e) distribution and sharing on the Internet, on the radio or television.
5.2. The organizer also acquires the right to authorize dependent copyright to work, without temporary and territorial restrictions, in the fields of operation indicated in point 5.1. above.
5.3. The laureate undertakes not to report any claims against the organizer of the Competition for the use of the submitted competition work in accordance with the provisions of these Regulations.
5.4. By sending a competition work together with a competition application, the participant in the competition declares that:
- a) is the author of the submitted competition work and therefore he has all copyright and related rights to it, and these rights are not limited or burdened with the rights of third parties in any way.
- b) The competition work does not violate the rights of third parties and therefore no third parties will apply against the organizers in connection with the use of the organizer from the competition work.
- c) undertakes to dismiss the Organizer from all claims submitted by third parties in connection with the organizer's use of the competition work to the extent specified in the Regulations, resulting from the participant's submission of false statements, as well as to repair the damage arising in this respect.
5.5. Sending a competition work in which the image of third parties has been recorded is tantamount to the participant's statement or his statutory representative that he has the consent of these persons to use this image, his public presentation and granting the organizer permission to use the image on the principles set out in the regulations.
5.6. The organizer may transfer the rights of a competition he acquired for third parties without the consent of the laureate.
- Processing of personal data of the competition participants:
6.1. The administrator of the participants' personal data is the organizer.
6.2. The organizer processes the personal data of the participants in accordance with the Personal Data Protection Act of August 29, 1997 (Journal of Laws of 1997 No. 133 item 883, as amended) in order to implement the competition, issue and settlement of prizes.
6.3. Participants, and in the case of underage participants, their statutory representatives provide personal data voluntarily and have the right to access and correct them, delete demands, with the proviso that the refusal to provide data will prevent participation in the competition, issue and implementation of prizes.
6.4. Full an objection to the processing of personal data provided by the Participant of the Competition at any time of the competition, until its resolution is tantamount to failure to comply with formal requirements by the participant and the exclusion of the participant from participation in the competition.
6.5. The request to correct, update, rectify or delete the transmitted data should be sent to the email address hello@aoomistudio.live
- Final provisions:
7.1. The organizer conducts permanent monitoring of the competition and in the event of a reasonable suspicion of providing false or incomplete personal data by the Participant referred to in point 2.1.2. Of the Regulations, the Organizer reserves the right to verify personal data provided by the Participant during the competition or when settling the competition or awarding prizes.
7.2. Decision covered by point 7.1. Above, applies to third parties or people intending to become participants, who in particular take actions to obtain participation in the competition and/or victory in the competition in a dishonest way and disagreement with the principles of "fair play".
7.3. The organizer is not responsible if, as a result of service providers (e.g. mail, carriers, telecommunications enterprises, computer network administrators, the defective operation of internet connections or software or computer equipment of the participant) or events related to the performance of services having the nature of higher force, he will not be able to comply with all or part of the obligations provided for in these regulations, despite the submission of special care by the organizer.
7.4. The organizer reserves the right to make changes to the Regulations during the competition, if it is justified by the purpose of the competition and clarify the conditions of participation in the competition, except that these changes cannot violate the rights of already acquired participants. These changes apply from the date of posting on the website.
7.5. All complaints regarding the course of the competition will be accepted within 7 calendar days from the date of the competition. Complaints will be settled by the Commission within 7 calendar days from the date of receipt of the complaint.
7.6. Complaints should be sent by registered mail to the Organizer's address with the note "Complaint: Competition (name of the competition specified on Instagram)". The complaint should include: name, surname, exact address of the participant, as well as indicating the reason for the complaint and a specific behavior by the organizer.
7.7. A person submitting a complaint will be informed in writing about the decision by registered mail, sent to the address provided in the complaint within 7 days from the date of consideration of the complaint. The organizer may also notify the decision by phone or via e -mail.
7.8. "The competition is not sponsored in any way, supported or conducted by Facebook or associated with it. The Facebook portal is fully released from the responsibility by each participant of the competition."
